PhotoRepair Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the PhotoRepair mobile application (“App”). By downloading, installing, or using PhotoRepair, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using PhotoRepair, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you accept these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use PhotoRepair for your personal or internal business purposes, subject to these Terms and the Apple Media Services Terms. This license does not allow you to:

  • Copy, modify, distribute, sell, or lease any part of the App.
  • Reverse engineer, decompile, or attempt to extract the source code or AI models, except where permitted by law.
  • Use the App for any unlawful, infringing, or harmful purpose.

3. Your Content, On-Device Tools and Cloud AI

You retain full ownership of all images you create, import, or edit using the App (“Your Content”). You are solely responsible for Your Content and for ensuring you have the rights necessary to edit and use it.

  • On-device tools. Erase, Enhance, Restore, Cutout, Replace Background, Blur, Filters, Adjust, and the location tools process your photos on your device. Those photos are not uploaded to us.
  • Cloud AI features. “Edit with words” and “Create an image” run on servers. When you use them, the text you type and any photo you attach are sent to our server and on to third-party AI model providers (currently Google and Pruna AI) to produce the result, as described in our Privacy Policy. The App asks for your permission before the first upload. By using these features you confirm that you have the right to send that content, including the consent of any person who appears in it where the law requires it, and you grant us and those providers the limited permission needed to process it to deliver the result to you. We claim no ownership of what you send or of the results.
  • AI results. Results are generated by automated models. They may be inaccurate, may resemble content produced for other users, and may not be eligible for copyright protection in your country. A request may be declined by a provider’s safety systems; a request that produces no image is not charged.

4. Acceptable Use

You agree not to use PhotoRepair to:

  • Create, edit, or distribute content that is illegal, defamatory, obscene, or that infringes the intellectual property, privacy, or other rights of any third party.
  • Generate misleading, deceptive, or fraudulent imagery, including content intended to impersonate others or spread misinformation.
  • Remove watermarks, copyright notices, or metadata from images you do not own or have permission to modify.
  • Create sexual content involving minors, non-consensual intimate imagery, or content that harasses or exploits a real person, or attempt to get around the safety systems of the cloud AI features.
  • Access our servers other than through the App, or interfere with, overload, or abuse them — including attempts to obtain AI credits you have not paid for.

You are solely responsible for how you use the App’s tools, including object removal, background editing, restoration, and metadata removal features.

5. Accounts

You can use PhotoRepair without an account. Signing in with Apple, Google, or an emailed code is optional and lets your AI credits follow you to another device. You are responsible for activity under your sign-in. You can sign out or delete your account at any time in the App’s Me tab; deleting your account permanently forfeits any unused AI credits. Subscriptions are tied to your Apple Account, are not cancelled by deleting your PhotoRepair account, and can be restored in the App.

6. Subscriptions, Credit Packs and AI Credits

PhotoRepair offers optional paid features through in-app purchases: PhotoRepair Pro, an auto-renewing subscription billed weekly or yearly, and one-time credit packs.

Subscriptions

  • PhotoRepair Pro removes the export limits on the App’s Pro tools and includes an allowance of AI credits for each billing period. The price, the period, and the allowance are shown on the purchase screen before you buy.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel subscriptions in your App Store account settings. Cancelling stops future renewals; Pro remains active until the end of the period already paid for.

AI credits

  • The cloud AI features are paid for with AI credits. Each image costs a number of credits that depends on the quality you choose (Fast, Standard, or HD); the cost is shown before you send a request. Credits are charged only when an image is delivered.
  • Credits included with a subscription belong to that billing period: unused credits expire at the end of the period and do not roll over. Credits from credit packs do not expire while the service is offered. Subscription credits are used before pack credits.
  • Credit packs are consumable purchases. They add credits only and do not include PhotoRepair Pro. Once bought they cannot be restored through “Restore Purchases”; your balance is kept on our server and stays with your installation or, if you sign in, your account.
  • Credits have no cash value, are not transferable, cannot be exchanged for money, and can be used only in PhotoRepair. If a purchase is refunded or reversed, the credits it provided are removed, which can leave a negative balance to be offset by later credits.
  • We may change what features cost in credits, or the models behind each quality, for future requests.

Payments and refunds

  • All purchases are processed by Apple through the App Store. We do not collect or have access to your payment information.
  • Except where required by law, payments are non-refundable. Refund requests are handled by Apple in accordance with its policies.

7. Intellectual Property

The App, including its software, design, AI models, trademarks, and branding, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other proprietary materials except as expressly permitted herein.

8. Third-Party Models and Components

PhotoRepair incorporates third-party and open-source AI models and libraries, each governed by its own license. Your use of the App is also subject to those licenses where applicable. The cloud AI features rely on third-party AI services, whose own usage policies also apply to what you send through them. We may change, replace, or remove models and providers. We make no warranties regarding third-party components or services.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that processing results will meet your expectations. AI-generated or AI-edited results may contain inaccuracies or artifacts. The cloud AI features need an internet connection and depend on third-party services; they may be slow, unavailable, changed, or discontinued.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, or profits, arising out of or related to your use of the App. Your photos, projects, and AI conversation history are stored on your device, not on our servers, so you are responsible for maintaining backups of your original photos. Our total liability for any claim shall not exceed the amount you paid for the App, if any, in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access to the App or to the cloud AI features at any time if you violate these Terms or misuse the service. Upon termination, the license granted to you ends, and you must stop using the App. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted within the App or on our official website, and the “Effective Date” will be updated accordingly. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of the applicable jurisdiction.
